1. Acceptance of Terms
By using the services of Appalachian Delivery & Courier ("Company," "we," "us," or "our"), you ("Customer," "you," or "your") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Service Description
Appalachian Delivery & Courier provides delivery and courier services including but not limited to:
- Food and grocery delivery
- Medical courier services
- Legal document delivery
- Personal errand services
- General package delivery
3. Service Area and Availability
Our services are available in West Jefferson, NC, and surrounding areas as determined by the Company. Service availability may vary based on weather conditions, driver availability, and other factors. We reserve the right to modify our service area at any time.
4. Booking and Payment
Services must be booked by calling (336) 340-3366 during business hours. Payment is due upon completion of delivery unless other arrangements have been made. We accept Zelle, credit cards, and other approved payment methods.
5. Customer Responsibilities
Customers are responsible for:
- Providing accurate pickup and delivery information
- Ensuring items are properly packaged and ready for pickup
- Being available at delivery location or providing access instructions
- Ensuring items comply with legal shipping requirements
- Payment of all applicable fees
6. Prohibited Items
We do not transport:
- Illegal drugs or controlled substances (except legally prescribed medications)
- Weapons, firearms, or ammunition
- Hazardous materials or dangerous goods
- Perishable items requiring special temperature control (unless specifically arranged)
- Items valued over $1,000 without prior arrangement
- Any items prohibited by local, state, or federal law
7. Liability and Insurance
The Company maintains liability insurance for normal delivery operations. Our liability is limited to the lesser of the actual value of the item or $100 unless a higher declared value is arranged and additional fees are paid. We are not liable for consequential, indirect, or punitive damages.
8. Delivery Timeframes
While we strive to meet estimated delivery times, all timeframes are estimates only. We are not liable for delays due to traffic, weather, or other circumstances beyond our control. Priority and emergency services are available for time-critical deliveries.
9. Cancellation and Refunds
Services may be cancelled without charge before pickup begins. Partial charges may apply if pickup has already commenced. Refunds are handled on a case-by-case basis depending on the circumstances of cancellation.
10. Privacy and Confidentiality
We respect your privacy and maintain confidentiality of all deliveries. This is especially important for medical and legal courier services. Please see our Privacy Policy for detailed information about data handling.
11. Indemnification
Customer agrees to indemnify and hold harmless the Company from any claims, damages, or expenses arising from the shipment of prohibited items, misrepresentation of item contents, or violation of applicable laws.
12. Modification of Terms
We reserve the right to modify these Terms of Service at any time. Updated terms will be posted on our website. Continued use of our services after posting of updated terms constitutes acceptance of those terms.
13. Governing Law
These Terms of Service are governed by the laws of the State of North Carolina. Any disputes will be resolved in the courts of Ashe County, North Carolina.
